From Legal Compliance to Maqāṣid-Based Safeguarding: A Systematic Literature Review on the Prevention of Sexual Violence Against Children in Pesantren

Child sexual violence in pesantren reflects a complex problem that extends beyond individual misconduct to include power relations, religious authority, cultures of obedience, and weak institutional protection mechanisms. This article aims to examine research trends, dominant themes, research gaps, and opportunities for developing a Maqāṣid-Based Child Safeguarding framework for preventing child sexual violence in pesantren. This study employed a systematic literature review using narrative-thematic synthesis of 50 selected articles drawn from an initial pool of 1,090 Scopus-based records. Articles were selected based on their relevance to child protection, sexual violence, pesantren or religious educational institutions, and maqāṣid al-sharī‘ah. The findings indicate that existing literature is dominated by legal and policy studies, reporting and referral mechanisms, and school-based prevention programs. However, studies that explicitly integrate pesantren, child sexual violence, and maqāṣid al-sharī‘ah remain limited. This review concludes that child protection in pesantren should move beyond legal compliance toward a maqāṣid-based safeguarding system that incorporates prevention, safe reporting, referral, victim recovery, and institutional accountability. The study contributes by positioning maqāṣid not merely as a normative Islamic legal foundation, but as an operational framework for institutional child safeguarding. Its implications highlight the need to develop indicators, standard operating procedures, and empirical models of pesantren safeguarding centered on children’s safety, dignity, and well-being.
